According to the Employment Exchange (CNV) Act, 1959 and the Rules, 1960 framed there under, it is obligatory on the part of the employer to furnish the ER-I and ER-II returns to the Employment Exchange regularly. The EMI programme relates to the “Organised sector of our economy”. This organized sector covers all establishment in the public sector, irrespective of the size and non-agricultural establishment in the private sectors employing 10 or more persons. Accordingly information in respect of public sector establishment and non-agricultural establishment in the private sector employing 25 or more persons is collected statutorily under the provisions of the Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959 and information from smaller non-agricultural establishments on voluntary basis. The EMI data are furnished by the establishments through the ER-I and ER-II returns.

The Form ER-I is used for the collection of information from the establishments (Public/Private Sectors) at quarterly intervals i.e. 31st March, 30th June, 30th September and 31st December of each and every year.

The Form ER-II is used for collection of information regarding Occupational and Educational details of employees in Public/Private Sector in alternative years (i.e., biennial return) from private sector in odd years (2015, 2017 etc.,) and from Public sector in even years (2016, 2018 etc.,). This return ER-II should be collected in addition to the quarterly Employment return on Form ER-I in 3rd quarter (i.e.) 30th September.
